房屋租赁意向书                                                                                                                                

    甲方: 西安航空发动机集团天鼎有限公司                                                                                                                                

    乙方:                                                                                                                                

    甲、乙双方本着公平、公正、平等、互利的原则,就乙方租赁甲方位于   陕                                                                

    西省  省  西安   市  渭滨   路  507   号楼 二层  物业,开设        小六汤包餐厅         事宜,签订此意向:                                                                

    一、标的物业                                                                

    双方确定乙方租赁甲方位于   陕西省  省  西安   市  渭滨   路  507   号楼  二层  物业作为未来经营    小六汤包餐厅      的场地,租赁面积为  695 (暂定)   平方米(签约面积以国家相关测量部门测量数据为主)。(后附图纸红色线内为租赁标地)                                                                

    二、合作条件                                                                

    1、 双方商定的交房标准为:                                                                

    甲方:提供乙方所需手续,签订正式《房屋租赁合同》。                                                                

    乙方:提供甲方所需手续,同意并签订正式《房屋租赁合同》,并按照正式《房屋租赁合同》履行合同内容。                                                                

    2、 双方同意在签订正式房屋租赁合同时,按照当时市场价格商定租赁费用,确定租赁年限。                                                                                                                                    

    3、租金的支付方式和时间以甲、乙双方签订的正式租赁合同为准。                                                                

    4、乙方在具备甲方租赁条件时,甲方应按照约定的条件将房屋租赁给乙方。                                                                

    5、本意向书不具有法律效力,乙方待其上级监管部门批准同意后,与甲方签订正式房屋租赁协议。                                                                

    6、甲、乙双方就房屋签订《房屋租赁合同》后,本协议自动解除,双方互不主张其他任何责任。                                                                

    三、合作意向                                                                

    双方均同意就标的物业合作事宜与对方进行进一步商谈,并力争在近期内达成正式协议。                                                                

    四、双方约定                                                                

    1、本意向书自双方签章之日起生效,本意向书一式  贰  份,甲、乙双方各执  壹  份。                                                                

    2、本意向书于正式租赁合同签署后失效。

    1、 甲方应提供本意向书约定房屋的产权证、土地使用权证复印件、房屋平面图和房屋整体消防合格证复印件给乙方作为本意向书的附件。                                                                

    2、 甲方应允许乙方按相关部门的规定,在承租房屋外立面无偿安装、使用牌匾、灯箱等行业标识,并按同行业标准安装符合行业要求的消防设施,甲方提供方便,具体手续和费用由乙方自行办理和承担。

    双方承诺在双方正式签署《房屋租赁合同》后,甲方应

    第 维修养护责任                                                                

    租赁期间,甲方对房屋及其附着设施每隔 ____〔月〕〔年〕检查、修缮一次,乙方应予积极协助,不得阻挠施工。                                                                

    正常的房屋大修理费用由甲方承担;日常的房屋维修由____方承担。                                                                

    因乙方管理使用不善造成房屋及其相连设备的损失和维修费用,由乙方承担责任并赔偿损失。                                                                

    租赁期间,防火安全、门前三包、综合治理及安全、保卫等工作,乙方应执行当地有关部门规定并承担全部责任和服从甲方监督检查。                                                                                                                                

    第九条 关于装修和改变房屋结构的约定                                                                

    乙方不得随意损坏房屋设施,如需改变房屋的内部结构和装修或设置对房屋结构影响的设备,需先征得甲方书面同意,投资由乙方自理。退租时,除另有约定外,甲方有权要求乙方按原状恢复或向甲方交纳恢复工程所需费用。                                                                                                                                

    第十条 关于房屋租赁期间的有关费用                                                                

    在房屋租赁期间,以下费用由乙方支付,并由乙方承担延期付款的违约责任:                                                                

    1.水、电费;                                                                

    2.煤气费;                                                                

    3.电话费;                                                                

    4.物业管理费;

    在租赁期,如果发生有关部门征收本合同未列出项目但与使用该房屋有关的费用,均由乙方支付。                                                                                                                                

    第十一条 租赁期满

    第十二条 因乙方责任终止合同的约定                                                                

    乙方有下列情形之一的,甲方可终止合同并收回房屋,造成甲方损失,由乙方负责赔偿:                                                                

    1.擅自将承租的房屋转租的;                                                                

    2.擅自将承租的房屋转让、转借他人或擅自调换使用的;                                                                

    3.擅自拆改承租房屋结构或改变承租房屋用途的;                                                                

    4.拖欠租金累计达____个月;                                                                

    5.利用承租房屋进行违法活动的;                                                                

    6.故意损坏承租房屋的;

    第十三条 提前终止合同

    第十 合同效力                                                                

    本合同之附件均为本合同不可分割之一部分。本合同及其附件内空格部分填写的文字与印刷文字具有同等效力。                                                                

    本合同及其附件和补充协议中未规定的事项,均遵照中华人民共和国有关法律、法规执行。                                                                                                                                

    第十九条 争议的解决                                                                

    本合同在履行中发生争议,由甲、乙双方协商解决。协商不成时,甲、乙双方同意提交中国国际经济贸易仲裁委员会深圳分会仲裁,仲裁裁决是终局的,对双方均有约束力。                                                                                                                                

    第二十条 合同份数

    2、租赁合同签订后,如企业名称变更,甲乙双方可以对名称变更事项进行签字或盖章确认,但无论双方是否确认,均不因此影响租赁合同的条款内容和效力。                                                                

    3、本合同为意向合同,当满足以下条件(1)         ;(2)          后,甲乙双方签订正式租赁合同。当乙方确认该等条件不能满足时,可以向甲方发出通知(不论该等通知是否以书面方式进行),解除本意向协议。
