【中文摘要】大学生是国家的栋梁之才,是民族的希望和未来。不可否认,绝大多数大学生有着良好的专业素质和人文修养,大学生整体素质是积极向上的。然而,近些年来,屡屡发生的大学生违法犯罪事件撞击着人们敏感的神经,人人羡慕的“天之骄子”一下子就沦落为世人唾弃的“罪犯”。这不但是他们个人命运的转折,也是家庭希望的毁灭,同时造成国家资源和家庭资源的严重浪费。因此,有关大学生的培养、前途和命运应该成为整个社会共同关心的话题。本文从以下几个部门进行阐述,试着找出大学生违法犯罪的真正原因,从而提出切实可行的预防方案:第一部分阐述了大学生违法犯罪的概况,第一,界定了本文大学生的范畴,明确大学生违法犯罪的概念;第二,阐述了大学生违法犯罪现状,大学生违法犯罪呈显著上升趋势,恶性犯罪也频见报端;第三,概括了大学生违法犯罪的特点,违法犯罪主体广泛,违法犯罪类型主要以侵害财产性违法犯罪为主,网络犯罪和传销也日益盛行;第四,大学生违法犯罪对其个人和整个社会造成的恶性影响。第二部分分析了大学生违法犯罪的原因,第一,社会转型时期不健全的社会是造成大学生违法犯罪的重要原因;第二,教育中重知识、轻道德法制教育的功利性教育模式使大学生缺乏正确的人生观、价值观、法制观;第三,社会、家庭、学校对大学生从小缺乏正确的心理引导;第四,学校周边不良社会环境加大了大学生违法犯罪的诱因;第五,社会、学校对大学生违法犯罪的纵容和隐瞒是导致大学生违法犯罪屡禁不止的原因之一;第六,法制普及教育缺乏有效的落实机制。第三部分根据大学生违法犯罪现状和违法犯罪原因提出了大学生违法犯罪的预防对策思考。第一,减小差距,完善社会保障体系,建立和谐的社会;第二,加强教育改革,加大德育培养和法律基础教育课时力度和功效;第三,改进现有人文教育模式,提高大学生人文修养;第四,充分发挥学校、家庭和社会对大学生心理辅导中的作用;第五,净化校园周边环境,减少大学生违法犯罪诱因;第六,法律面前人人平等,杜绝法外容情;第七,法制普及教育落到实处,营造人人懂法、自觉守法的氛围。
【英文摘要】University students are the useful members of the society.They are the hope and future for our nationality. It is undeniable that most of them have good professional quality and culture cultivation.Overall quality of the university students is active and upward. However, in recent years, university crimes occurred frequently against people’s sensitive nerve, the‘God’s favored one’suddenly reduced to disgustful‘criminals’.It not only caused their fates twisting but also ruined their family’s hope.A lot of resources are wasted which provided by nationality and family. Therefore, the topic of the university students’ cultivation, future and destiny shall be concerned by whole society.This paper will expatiate on the university students’crime reson from several parts as below and try to put forward relevant feasible prevention measures.The first part expatiates on the general situation of the university students’crime. Firstly, define the category of the university students and the concept of university students’crime. Secondly, expatiate on the current status of the crimes commited by university students. The crimes trend of university students is increasing obviously and some malignant crimes are also reported frequently.Thirdly, summarize the characteristic of the university students’crime, the crime subject is broad.The main crime types are property violation and the net&MLM crimes is becoming increasingly popular. Fourthly, university students’crime will cause malignant influence on individuals and whole society.The second part analyse the causation for university students’crime. Firstly, the society system and the economy mode are the root causation for university students’crime. Secondly, the university students lack the right philosophy, values,legal system concept because of the long-term wrong education mode.It always attach importance to knowledge education and ignore the legal&moraleducation.Thirdly,family and society don’t give much right mentality leading for children when they were young.Fourthly,The interpenetration and mentality between universities and society increase the university students’crime inducement.Fifthly, universities and society always connive&hide the students’crime. It is one of the causations for university students’crime.Sixthly, legal system popularization &education activites are short of the effective implementation mechanism.The third part provides the prevention measures for students’crime according to crime’s status and resons. Firstly, minimize the gap of wealth, perfect the social security system and establish the harmonious society system. Secondly, strengthen the education system’innovation and enhance the moral education and education efficacy of the basical legal education.Thirdly, improve the current education mode and promote university students’humanities culture.Fourthly, maximize the function of the psychology tutorship provided by schools,family,society during the students developmental process.Fifthly, purify the circumstance around the university and reduce the university students crime’s inducement.Sixthly,everyone is equal before the law and the law is no respecter of persons.Seventhly,the legal system popularization education shall be implemented smoothly and create the atmosphere of everybody knowing law and abiding the law.
